Minimum qualification required is a bachelor’s degree from a recognised tertiary institution
Master’s Degree in Labour Law will be an advantage
Must be admitted as an Attorney/ Advocate
At least 5 years’ experience in the labour environment after having been admitted as an attorney
Other Business Management/ Leadership related qualifications/certificates will be an advantage

The main responsibility for this position is to ensure overall management of the legal function including developing and implementing a legal strategy.
To ensure collection of the debtor’s book through the Council’s legal framework as well as Identify and manage potential risks.
Develop legal policy and ensure the proper implementation thereof. The successful candidate will be responsible for the legal compliance and providing sound legal advice on litigation.
Core duties include managing all legal risks to the organisation, ensuring legal compliance and proper contract management within the organisation, providing legal opinions and advice, contract services and litigation management.
The incumbent will be required to contribute to and ensure implementation of strategic organisational objectives as well as provide operational direction for the legal function.

Duties and Responsibilities
Leadership and Strategic Management
Overall management of legal functions.
Provide assessments of the appropriateness and adequacy of legal systems and procedures on an annual basis.
Provide a consolidated report and make recommendations to the governing board and various committees on legal issues, material breaches, potential compliance breaches and legal related correspondence received.
Escalate and provide recommendations on any matters that may require the attention of or a decision by the governing board.
Assist with the promotion of a culture of compliance and awareness by coordinating and implementing compliance projects and training initiatives.
Maintain relationships with the various regulators.
Assist with the compilation of responses pertaining to queries received from the various regulators.
Maintain and promote a compliance strategy to ensure that stakeholders receive optimal legal support.

Risk Management and Legal Compliance
Identify and manage the legislative framework.
Identify areas of risk and implement appropriate policies and procedures to curtail risk.
Identify legal risks and implement controls.
Ensure timeous reporting of legal risks and incidents.
Manage the exemption application process and appeal process and ensure uniform implementation across regions.

Report legally related issues to the governing board, executive management and various committees on legal-related issues.
Review legal performance on an ongoing basis, recommend the alignment of processes, provide guidance and report on it.

Systems and Policy Development
Advise and provide guidance to senior management on systems, policies, processes and controls implemented to ensure legal compliance.
Update and implement policies.

Budget/ Legal Collections and Reporting
Develop and manage the central budget and costs of all legal activities.
Report periodically (monthly, quarterly and annually) on the performance of the Legal nationally.
Collect and report on the national debt book.

Knowledge of the Motor Industry Bargaining Council’s Collective Agreements and relevant governing Legislation i.e. LRA, Pension Fund Act, Credit Act etc. will be a definite advantage.
In-depth knowledge of the Labour Relations Act and related employment legislation as well as Labour Court processes and procedures with sound knowledge of Civil procedure is required.
Excellent document drafting skills and advanced experience of the drafting of opinions.
Management and leadership skills at senior level and proven record of leading senior managers
Stakeholder management.
Financial acumen with emphasis on revenue collection within the legal environment.
Ability to lead a team to deliver results.
Ability to develop strategy aligned to an organization’s objectives.
Be able to contextualize the environment and the ability to collaborate with others.
Effective communication.
Ability to interpret and analyse information to facilitate sound decision making and problem solving.
Computer Literacy (MS Word and Excel).
